Education Law

Education Law

Ensuring Students' Rights to Education

Every child deserves an education that meets their unique needs, but navigating the legal requirements for special education services can be overwhelming. Parents often face roadblocks when requesting evaluations, securing accommodations, or resolving disputes with schools.

Danna McKitrick’s education law attorneys advocate for families to ensure students with disabilities receive the resources and support they are entitled to under the law. Whether negotiating an Individualized Education Plan (IEP), securing accommodations under Section 504, or handling disputes with school districts, we provide the legal guidance necessary to protect your child’s educational rights.

Guiding Families Through Special Education Law

Federal and state laws establish the rights of students with disabilities, but enforcing those rights often requires legal intervention. The Individuals with Disabilities Education Act (IDEA) and Section 504 of the U.S. Rehabilitation Act require schools to provide appropriate accommodations, but obtaining those services can be a challenge. Our attorneys work closely with families to ensure schools comply with their legal obligations.

We assist parents in requesting evaluations for special education services, ensuring schools properly assess a child’s needs and eligibility. When accommodations are necessary, we help families develop and negotiate IEPs and 504 plans that provide the appropriate educational support. If disagreements arise, we represent parents in meetings, mediation, and legal proceedings to resolve disputes.

Addressing Special Education Disputes

When schools fail to meet their legal obligations, parents may need legal representation to advocate for their child’s rights. Our attorneys handle disputes involving the denial of services, inappropriate disciplinary actions, and failures to implement accommodations. We work to resolve conflicts with schools, districts, and school personnel through negotiation and, when necessary, formal legal proceedings.

For families facing due process hearings, our team provides legal representation to ensure students receive the services they are entitled to. We also assist with reviewing educational documents, advising on behavioral intervention plans, and challenging unfair disciplinary actions that impact a student’s access to education.

Supporting Students at Every Level

Legal protections for students with disabilities extend beyond primary and secondary education. College students also have the right to reasonable accommodations to ensure equal access to education. Our attorneys assist students in securing disability-related services, addressing accessibility issues, and advocating for fair treatment in academic institutions.

Advocates for Your Child’s Future

Ensuring a child receives the right educational support can be a complex and emotional process. At Danna McKitrick, we work alongside families to navigate the legal system, secure necessary services, and protect students’ rights. If you need guidance on special education law, accommodations, or disputes with a school, contact us to discuss how we can help.
