Public Pensions & Government Litigation

Public Pensions & Government Litigation

Protecting Your Rights, Benefits, and Resources

Whether dealing with public pensions, municipal disputes, administrative actions, or statutory compliance, individuals and organizations must be prepared to navigate an intricate legal landscape. Success requires attorneys who understand the inner workings of government agencies, the nuances of regulatory law, and the endurance to see cases through to resolution.

At Danna McKitrick, our Government Services Group represents public pension systems, municipalities, government employees, and private entities in legal matters involving government agencies. We have successfully advocated for clients at all levels of government, including Missouri and Illinois state courts, federal courts, appellate courts, and the Missouri Supreme Court. Whether through negotiation, litigation, or alternative dispute resolution, we protect our clients’ rights, resources, and financial security.

Public Pension Litigation and Compliance

Public pension systems must balance fiscal responsibility, regulatory compliance, and the duty to provide earned benefits to retirees. Disputes can arise over funding obligations, pension restructuring, or legal challenges to benefit policies, often requiring litigation to ensure pension funds are properly managed and protected.

Our firm has an extensive track record of success in public pension law, including multiple victories before the Missouri Supreme Court. We assist pension boards, municipalities, and government employees with:

  • Funding disputes and government obligations related to pension contributions
  • Regulatory compliance and pension governance to ensure adherence to state and federal laws
  • Litigation to protect pension beneficiaries from underfunding or unlawful reductions in benefits
Defining Cases. Powerful Advocacy.
Fireman's Retirement Fund v. St. Louis

In Firemen’s Retirement System v. St. Louis regarding failure to properly fund pensions, Danna McKitrick, P.C. earned a judgment in excess of $18 million against the City of St. Louis. On appeal, the Missouri Supreme Court affirmed that FRS prevailed on all issues. In September 2007, FRS received $49.4 million from the City of St. Louis based on this judgment, interest, and money for the next two fiscal years.

Government Litigation and Administrative Law Disputes

When legal disputes involve government agencies, policies, or public funds, they require attorneys with a deep understanding of administrative and constitutional law. Our attorneys represent municipalities, public agencies, government employees, and private parties in lawsuits involving:

  • Municipal and administrative disputes, including funding, policy, and regulatory challenges
  • Statutory compliance matters, ensuring government agencies uphold legal requirements
  • Employment and benefits litigation, protecting the rights of government employees and retirees
  • Taxation-related disputes, including the allocation, collection, and use of public funds
Defining Cases. Powerful Advocacy.
Klingler, et. al. v. Director of the Department of Revenue, State of Missouri

In Klingler, et al. v. Director of the Department of Revenue, State of Missouri, Danna McKitrick, P.C. led a victorious, 10-year, hard-fought class-action case that made several trips to the federal appellate courts. The battle succeeded in reaffirming the principles of the Americans with Disabilities Act, “that people with disabilities cannot be charged for accommodations required by law.”

Alternative Dispute Resolution and Negotiation

While we are experienced litigators, we recognize that not all disputes need to go to court. In the public pension sector, we have helped resolve high-stakes disputes through negotiation and alternative dispute resolution, avoiding unnecessary delays and preserving privacy.

Our attorneys work to:

  • Negotiate settlements in pension and municipal disputes to secure fair outcomes
  • Engage in mediation and arbitration to resolve government-related legal conflicts efficiently
  • Develop proactive legal strategies that protect our clients from prolonged litigation
